1. About these Terms
These Terms & Conditions ("Terms") govern your access to and use of the Cashviber platform across all of its surfaces (collectively, the "Services"):
- the Campaign Site — our fundraising and campaign website at
fundraising.cashviber.comand related web pages; - the Mobile App — the Cashviber applications for iOS and Android; and
- the Admin Portal — the administrative and operations console at
[ADMIN_DOMAIN], available only to authorized personnel and partners of Cashviber (see Section 15).
These Terms incorporate by reference our Privacy Policy, our Acceptable Use Policy (Section 12), and any product-specific or supplemental terms we present to you (together, the "Agreement"). The same defined terms carry the same meaning across all three surfaces so that your rights and obligations are consistent wherever you use Cashviber.
By creating an account, accessing, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by the Agreement. If you do not agree, do not use the Services.
2. Who we are and what we do
Cashviber is a technology platform that (a) lets organizers create, publish, and share fundraising Campaigns and receive Contributions, and (b) provides a Wallet and money-movement features that let users send, request, hold, and withdraw funds and pay by QR code or $handle.
We are a technology and software provider, not a bank, charity, broker-dealer, money manager, creditor, or fiduciary. Payment, custody, banking, and card-processing functions are provided by regulated third-party Payment Partners (see Section 8). Cashviber does not itself hold your funds except as, and to the extent, described for the Wallet feature and permitted by applicable law and our Payment Partners' terms.
3. Eligibility
To use the Services you must:
- be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to form a legally binding contract;
- not be barred from using the Services under the laws of your jurisdiction, and not be located in, or a resident of, any country or region subject to comprehensive sanctions, nor appear on any sanctions or prohibited-persons list; and
- provide accurate, current, and complete information and keep it up to date.
Certain features (money movement, withdrawals, larger transactions) require identity verification (Section 9) and are available only in supported regions and currencies.
4. Your account
4.1 Registration. You must register an account to use most features. You agree to provide accurate information, including a valid email and phone number, and to choose a unique username / $handle that identifies you within the Services.
4.2 One account; accurate identity. You may hold only one personal account unless we authorize otherwise. You must not impersonate any person or entity or misrepresent your affiliation.
4.3 Security. You are responsible for safeguarding your credentials and any security PIN or biometric lock, and for all activity under your account. Notify us immediately at [SECURITY_EMAIL] of any unauthorized use. We are not liable for losses arising from your failure to keep credentials secure, to the extent permitted by law.
4.4 Communications. You consent to receive communications from us electronically — in-app messages, push notifications, email, and SMS — including transactional, security, and legally required notices. Some communications are essential to the Services and cannot be opted out of while your account is active.
5. Campaigns (crowdfunding)
5.1 Organizer responsibility. If you create a Campaign (an "Organizer"), you are solely responsible for the Campaign, including its accuracy, legality, the truthfulness of its description and media, the use of funds raised, delivery of any promised outcome, and all tax, reporting, and legal obligations. Cashviber does not endorse, guarantee, vet the merits of, or take responsibility for any Campaign or Organizer.
5.2 No guarantee of funds or tax treatment. We do not guarantee that any Campaign will raise funds. Contributions are generally made as voluntary donations/gifts and, unless expressly stated and independently verified, are not tax-deductible and do not create an investment, security, loan, or equity interest. Organizers must not describe a Campaign as tax-deductible or as an investment unless legally accurate and permitted.
5.3 Use of funds. Organizers must use funds only for the stated purpose. Materially misusing funds, misrepresenting a Campaign, or failing to deliver a promised outcome is a breach of these Terms and may be unlawful. We may withhold, freeze, reverse, or refund funds where we reasonably suspect fraud, misuse, legal violation, or a Payment Partner or network requirement.
5.4 Prohibited Campaigns. You may not create Campaigns for any purpose prohibited by the Acceptable Use Policy (Section 12), by applicable law, or by our Payment Partners or the card networks.
6. Contributions (donors)
6.1 Voluntary contributions. When you contribute to a Campaign (a "Donor"), you authorize the charge and instruct us and our Payment Partners to process it. Contributions are generally final. Because Organizers control their Campaigns, Cashviber does not guarantee how funds are used and generally cannot compel refunds.
6.2 Refunds and chargebacks. Refund eligibility, if any, is described at the point of contribution and is subject to our Payment Partners' and the card networks' rules. Initiating a chargeback without first contacting us may result in account suspension. We may recover from your Wallet or payment method amounts owed due to reversals, chargebacks, or refunds.
6.3 Anonymity. You may choose to contribute anonymously where the feature is offered; your name will then be hidden from the public Campaign page, though we and the Organizer's Payment Partner may still process the transaction and retain records as required by law.
7. Wallet, transfers, and withdrawals
7.1 Wallet. Where available, your Wallet reflects funds associated with your account. Funds held via a Payment Partner are subject to that partner's terms; Wallet balances are not bank deposits and, unless expressly stated, are not insured (e.g., not FDIC-insured) and do not earn interest.
7.2 Send / request / pay. You may send or request funds to other users by $handle, contact, or QR code, and pay or collect via QR. You are responsible for confirming the recipient before sending; transfers may be irreversible once completed.
7.3 Withdrawals. You may withdraw eligible funds to a linked, verified bank account or payout method, subject to verification, limits, holds, processing times, and Payment Partner rules. We may apply holding periods or limits for risk, compliance, or network reasons.
7.4 Limits and holds. We may set, change, or remove transaction, balance, or velocity limits, and may hold, delay, freeze, or reverse transactions for verification, fraud prevention, legal compliance, or as required by a Payment Partner or authority.
7.5 Unclaimed funds. Funds that remain dormant or unclaimed may be handled in accordance with applicable unclaimed-property (escheatment) laws.
8. Payments and Payment Partners
Payments, bank linking, custody, and payouts are provided by regulated third parties — for example, card and account processors, bank-linking providers, and payout networks (each a "Payment Partner"). By using money features you also agree to the applicable Payment Partner's terms and privacy notice, which we will identify at the point of use. You authorize Cashviber and our Payment Partners to initiate the debits, credits, transfers, and account verifications necessary to provide the Services. We are not responsible for a Payment Partner's acts or omissions, subject to applicable law.
9. Identity verification, KYC, and AML
To comply with applicable anti-money-laundering (AML), counter-terrorist-financing, sanctions, and know-your-customer (KYC) obligations, and our Payment Partners' requirements, we may require you to provide identifying information and documents (e.g., legal name, date of birth, address, and government-issued ID or other verification). You authorize us and our verification providers to collect and verify this information. We may refuse, limit, suspend, freeze, or close an account or transaction, or report activity to authorities, where required or where we reasonably suspect fraud, sanctions exposure, or unlawful conduct. Identity documents are handled as sensitive personal data and stored using access-restricted, non-public storage as described in the Privacy Policy.
10. Fees
Fees, if any, are disclosed to you before you incur them and/or in a published schedule at [FEES_URL]. Currency conversion, if applicable, may include a spread or fee applied by us or our Payment Partners. Payment Partners and networks may charge their own fees. We may change fees prospectively on notice as required by law. You are responsible for all taxes associated with your use of the Services, except taxes on our net income.
11. User content and media
11.1 Your content. You may upload text, images, video, and other content ("User Content"), including Campaign media. You retain ownership of your User Content.
11.2 License to us. You grant Cashviber a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g., generate thumbnails/previews and format conversions), publish, and display your User Content solely to operate, promote, and improve the Services — for example, showing Campaign media on public Campaign pages and previews. You represent that you have all rights necessary to grant this license and that your User Content does not infringe third-party rights or violate law.
11.3 Moderation. We may (but are not obligated to) review, refuse, remove, or restrict User Content or Campaigns that we believe violate the Agreement or applicable law. We are not responsible for User Content, which reflects the views of its author, not Cashviber.
11.4 Intellectual-property complaints. If you believe content infringes your rights, contact [IP_EMAIL] with the information required by applicable law (e.g., DMCA). We may remove infringing content and terminate repeat infringers.
12. Acceptable Use Policy
You must not, and must not permit others to, use the Services to:
- break any law or regulation, or fund or facilitate illegal activity;
- engage in fraud, deception, money laundering, terrorist financing, sanctions evasion, or unlicensed money transmission;
- raise funds for or transact in: weapons, ammunition, or explosives; illegal drugs or controlled substances; sexual or adult services; human trafficking or exploitation; gambling or lotteries where prohibited; counterfeit or stolen goods; pyramid, Ponzi, or multi-level-marketing schemes; hate, harassment, or violent-extremist causes; or any other category prohibited by law, our Payment Partners, or the card networks;
- infringe intellectual-property, privacy, or publicity rights;
- upload malware, or attempt to breach, probe, scrape, overload, reverse-engineer, or circumvent the security, access controls, or rate limits of the Services;
- impersonate others, create fake Campaigns, or manipulate donations (e.g., self-funding to appear legitimate, or laundering funds through Campaigns);
- collect or misuse other users' data, or send spam or unauthorized communications.
Violations may result in immediate suspension or termination, fund holds or reversals, and referral to authorities.
13. Third-party services
The Services may link to or integrate third-party sites, apps, or services (including Payment Partners, verification providers, app stores, maps, and social-sharing tools). We do not control and are not responsible for third parties; your use of them is governed by their terms and privacy notices.
14. Intellectual property; license to you
The Services, including all software, design, text, graphics, logos, and the "Cashviber" and "CA$HVIBER" marks, are owned by Cashviber or its licensors and protected by law. Subject to the Agreement, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Campaign Site and Mobile App for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works of the Services except as expressly permitted.
15. Admin Portal (authorized personnel only)
The Admin Portal is a restricted operations console for Cashviber's authorized employees, contractors, and partners ("Operators") only. It is not available to the general public. In addition to the rest of these Terms:
- Access is granted on a least-privilege, role-based basis and only for legitimate business purposes. Operators must use it solely within their assigned role and permissions.
- Operators must keep credentials confidential, use multi-factor or equivalent controls where provided, and never share access.
- Operators may access personal or financial data of users only as necessary to perform their duties and must handle it in accordance with the Privacy Policy, applicable data-protection law, and any confidentiality or employment agreement. Unauthorized access, export, or disclosure is strictly prohibited.
- Activity in the Admin Portal may be logged, monitored, and audited. Misuse may result in loss of access, disciplinary action, and civil or criminal liability.
Nothing in this Section grants any right of access to anyone who is not an authorized Operator.
16. Suspension and termination
You may stop using the Services at any time and request account closure. We may suspend, limit, or terminate your access, or remove content or Campaigns, at any time — with or without notice where permitted — if we reasonably believe you have violated the Agreement or the law, to protect users, Cashviber, or Payment Partners, or as legally required. On termination: your license to use the Services ends; we may retain and process data as required by law and our Privacy Policy; and provisions that by their nature should survive (e.g., Sections 6.2, 9, 11.2, 14, 17–20) survive.
17. Disclaimers
To the maximum extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, that any Campaign will succeed or that funds will be used as described, or that content is accurate. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
18. Limitation of liability
To the maximum extent permitted by law, Cashviber and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or funds arising from a third party's, Organizer's, or Donor's conduct. Our aggregate liability for any claim relating to the Services will not exceed the greater of (a) the total fees you paid to Cashviber in the [12] months before the event giving rise to the claim, or (b) [USD 100]. Nothing limits liability that cannot be limited by law (e.g., for fraud, or death or personal injury caused by negligence).
19. Indemnification
You will defend, indemnify, and hold harmless Cashviber and its affiliates and personnel from and against any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your Campaigns or User Content, your violation of the Agreement or the law, or your infringement of any third-party right.
20. Governing law and disputes
20.1 Governing law. The Agreement is governed by the laws of [GOVERNING_LAW_STATE/COUNTRY], without regard to conflict-of-laws rules.
20.2 Dispute resolution. [SELECT AND HAVE COUNSEL FINALIZE: e.g., informal resolution first (contact us for 30 days); then binding individual arbitration administered by [ARBITRATION_PROVIDER] under its rules, seated in [VENUE]; class-action and jury-trial waiver; and a small-claims and opt-out carve-out.] Where mandatory consumer-protection or local law grants you non-waivable rights (including for EU/UK/other consumers), those rights prevail and nothing here removes your right to bring proceedings in your local courts where the law so provides.
21. Changes to the Terms
We may update these Terms. We will post the updated version with a new effective date and, for material changes, provide reasonable notice (e.g., in-app or by email). Your continued use after the changes take effect constitutes acceptance. If you do not agree, stop using the Services and close your account.
22. Miscellaneous
Entire agreement; severability (invalid terms are limited or severed, the rest remains in effect); no waiver; you may not assign the Agreement without our consent, and we may assign it in connection with a merger, acquisition, or sale of assets; force majeure; the Services are controlled from [JURISDICTION] and you are responsible for local-law compliance; notices to you may be given in-app, by email, or by posting.
